That squirrel is in the wrong tree. Probably thinking – If I didn’t have bad luck, wouldn’t have any at all.

Oh they do. Pellets over the left edge of the nest ; pellets over the right edge. find one owl pellet and it’s a good idea to scan the nearby ground for any more – assuming you’re collecting owl pellets for some reason, like a census.

I had to play “Find the Nightjar” for a while to spot the squirrel. I presume the owl’s eyesight is better than mine, or he/she (can one tell?) will sure go hungry
The owl’s eyesight is definitely better than that poor nearsighted squirrel!
I’m guessing that the squirrel is safe unless the owls flies of a bit and gets some momentum for an attack. Those little guys are pretty good at keeping on the other side of a tree from something they don’t want to be close to.
The owl is showing a kind of defense display, as it is on its nest. I am not sure, but maybe the sqrll is not being seen as food just now.
That was my feeling too. The owl in hunting mode would spot the squirrel from above and reflexively swoop down on it. It’s presence in the tree is not going to ring the right bells.
